Explain why you were PK'd: Grief PK

Why should you be un-PK'd?: I am appealing this because this PK does not meet the PK Guidelines or the criteria for a Grief PK.

I was detained by a Mountaineer NCO. Then the individuals who detained me explicitly stated that I could be released and removed me from an office, however never untied me. While I was tied up, I walked to the BB Lobby, where I encountered Hauptmann Michael Braun. I informed him that I had already been cleared for release. Instead of listening to me or addressing the situation, he ignored what I said and immediately began dragging me.

At that point, I stated that if he was going to do this (continuing to drag me) despite being informed that I was cleared for release, I would pursue charges and court martial him for refusing to release me.                                    Under the PK Guidelines, a Grief PK requires severe harm to a Character, no harm was caused to Hauptmann Michael Braun’s character. A verbal statement about potential legal or punitive action does not constitute grief.           At most, this situation could be interpreted as dirt, not grief and even then, it was never acted upon.

The PK Guidelines explicitly state that PKs should be used as a last Resort and that attempts must be made to resolve the situation through roleplay first, unless impossible.                                                                                                  After I was released, Michael Braun alleged that I had "threatened" his "life" and re-detained me on his own initiative. He then dragged me away from the surrounding People, into a empty BB cell. Inside the cell while I was alone wtih him, he did not issue any warning to me and did not persue any other roleplay escalation with me (charges, interrogation, report etc). He simply left me tied in a cell for about 15 minutes and took absolutely no action or attempt to resolve the situation. I was left in the cell until some judges who later walked in released me. 

Following this incident, Michael Braun made a complaint to the Field Marshal inside of his office, claiming that I had threatened his life. During the Meeting the Field Marshal explicitly warned me that I was not allowed to make such threats to another officer and clarified that if I really wanted to charge him, I would require a really good justification. He also reminded Michael Braun to acknowldge my gorget and told him that if he wanted to detain me, he would also require a really good justifiaction and proper cause.

During the meeting, Michael made a complaint about me, but did not propose or request any form of resolution or disciplinary action despite having the opportunity to do so in the presence of the Field Marshal. Instead, he framed me in the complaint as having "threatened to kill" him. This does not reflect what I said to him at all in the original interaction. The Field Marshal provided guidance to both of us rather than issuing a punishment for either of us. This shows that the situation could've been resolved through roleplay means and did not warrant the immediate escalation to a PK. 

Michael Braun had multiple opportunities to resolve this situation through RP and chose not to engage at all before requesting a PK. This PK does not meet the pk criterea for Grief, was not used as Last Resort, and was not properly escalated in roleplay.

No severe harm occurred, no RP resolution was attempted, and a conditional statement regarding me charging him if he was going to continue dragging me, which was never acted upon, does not justify a immediate PK. Due to these reasons I believe this PK should be overturned.

Hello, I am the staff member who authorised your PK.

I want to clarify that the PK guidelines do not only allow for griefPKs for harm being done, but also for causing 'grief' to the player. I believe that the threat you issued during the scene was sufficient to fall under grief, as it implied a threat to the position and possibly the life of the player, via a possible court ruling. It also would seem not be the first instance of this happening.

Secondly, I want to clarify as to why I think this wouldn't fall under DirtPK.
Dirt PKs are done to silence an individual who might provide information to, let's say, a judge or a superior officer. In this case, this was a result of a direct threat of action and not simply blackmail.
